The judge ruled that 'mere insults, indignities, threats, annoyances, petty oppression, and other trivialities' don't constitute the type of behavior Wimbush-Polk accused Rose of, but rather a spat between in-laws.

Wimbush-Polk claimed in court papers, in her initial suit for defamation and emotional distress, that the South Philadelphia native in June cursed her out and claimed her poor parenting skills led to Lala's passing.
Wimbush-Polk said that Rose mistakenly thought she had reported her to California Child Welfare Services, leading to social workers visiting Rose - who shares son Sebastian, four, with Khalifa - on June 19.
In August, the pop culture queen - infuriated by the lawsuit - had been 'lawyering up' in a bid to obtain a restraining order against Wimbush-Polk, TMZ reported.
Rose denied calling Wimbush-Polk an 'unfit grandmother' in the blowup. The judge however find the suit not necessary and threw it out.
